Terms and Conditions for Buyers

1. General Terms and Conclusion of Contract
1.1 These General Terms and Conditions ("GTC") govern the use of our online store for purchasing digital products.
1.2 A legally binding contract is concluded between Affiliness (the "Provider") and the customer (the "Buyer").
1.3 By placing an order, the Buyer accepts and agrees to be bound by these GTC.
2. Scope of Service
2.1 The Provider offers digital products such as software, eBooks, and video/audio files.
2.2 All products are delivered electronically, either via direct download or access to a secured online area.
3. Warranty
3.1 The sale of digital products is subject to statutory warranty provisions under German law.
3.2 In the case of a defective product, the Buyer may request a replacement or repair. If the defect is not resolved, the Buyer may request a price reduction.
3.3 Additional warranty claims are excluded unless otherwise specified in the Liability section.
3.4 The warranty period is one (1) year from the date the digital goods are made available to the Buyer.
3.5 Obvious defects must be reported in writing within fourteen (14) days of delivery. An obvious defect is one that can be detected without specialized knowledge or close inspection.
4. Liability
4.1 The Provider endeavors to ensure uninterrupted access to its store and digital services. However, temporary downtime may occur due to maintenance or technical issues.
4.2 The Provider is not liable for damages that do not involve injury to life, limb, or health unless such damages are caused by gross negligence or a breach of essential contractual duties.
4.3 The Provider takes all reasonable measures to minimize service disruptions and restore functionality as quickly as possible.
5. Formation of the Contract
5.1 A contract is concluded once the Buyer places a product in the cart, completes the order form, and clicks the “Buy” button (or equivalent).
5.2 The Buyer then selects a payment method and completes the transaction. Once payment is confirmed, the Buyer receives an email with access details to the purchased product(s).
6. Software and Licenses
6.1 The use of software is subject to the applicable license terms.
6.2 The Buyer may not copy, modify, distribute, translate, or reverse engineer the software unless expressly permitted by the license or applicable law.
7. Prices
7.1 The price displayed in the shopping cart at the time of order is the final price payable by the Buyer.
7.2 Prices may include VAT, depending on the Buyer's location and applicable tax regulations.
8. Payment Terms
8.1 The Buyer can choose among the following payment methods:
- PayPal
- Stripe
- Credit card
- Electronic direct debit
- Bank transfer (prepayment)
8.2 PayPal
8.2.1 When paying with PayPal, the Buyer must ensure sufficient funds are available. PayPal's Terms and Conditions apply. Delivery occurs after payment confirmation.
8.3 Stripe
8.3.1 Stripe allows multiple local and international payment methods. Stripe's Terms and Conditions apply. Delivery is processed immediately after payment confirmation on Stripe's secure platform.
8.4 Credit Card
8.4.1 The amount may be reserved on the card at checkout, with the actual charge occurring shortly after. Delivery occurs immediately after the order is finalized.
8.5 Electronic Direct Debit
8.5.1 The Buyer is responsible for ensuring sufficient funds. In the case of a chargeback, resulting costs may be recovered via a debt collection agency. Delivery is processed upon order completion.
8.6 Bank Transfer (Prepayment)
8.6.1 The Buyer will receive bank account details during the checkout process and must transfer the full amount within 14 days. Delivery occurs only after the payment has been received.
9. Cancellation Policy
9.1 Unless the Buyer explicitly waives the right of withdrawal prior to completing the order, the Buyer may revoke the contract in accordance with the following terms.
9.2 The Buyer may cancel the purchase within fourteen (14) days without giving a reason. The period begins on the day the digital goods are made available.
9.3 To exercise the right of withdrawal, the Buyer must submit a clear written statement (e.g., by email, post, or contact form).
9.4 Obligations of the Provider
9.4.1 Upon receiving the cancellation, the Provider will refund all payments, including any delivery costs, within fourteen (14) days.
9.4.2 Refunds will be made using the original payment method unless otherwise agreed. No fees will be charged for processing the refund.
9.5 Obligations of the Buyer
9.5.1 If the product is digital, the Buyer must delete all copies from all devices after withdrawal. Access to protected areas will be revoked and data deleted accordingly.
9.5.2 To expedite the process and reduce environmental impact, electronic communication (e.g., email) is preferred. Withdrawal notices can be sent to [email protected] or via the contact form.
9.6 Withdrawal via Chargeback
9.6.1 Withdrawal through chargeback or unauthorized payment reversals is not valid. Costs incurred by the Provider as a result of such actions may be collected from the Buyer by a third-party collection agency.
10. Delivery
10.1 Unless otherwise stated, delivery is made by download link or access credentials sent via email.
10.2 Delivery typically occurs immediately after payment is confirmed.
11. Ownership and Use of Digital Goods
11.1 Unless otherwise agreed, the Buyer does not acquire ownership of the digital goods. A non-transferable, non-exclusive license is granted for personal use only.
11.2 Copying, sharing, or distributing the goods to third parties (including friends or family) is strictly prohibited. Violations may result in legal action.
11.3 Modifying, editing, or making the goods publicly available is not permitted. Legal enforcement may follow any violations.
12. Final Provisions
12.1 These GTC are governed by the laws of the Republic of Seychelles. The place of jurisdiction for any disputes shall be the Provider's registered business location, unless mandatory legal provisions dictate otherwise.
12.2 If any provision of these GTC is found to be invalid or unenforceable, this shall not affect the validity of the remaining provisions.
12.3 In such a case, the invalid or missing provision shall be replaced by one that most closely reflects the economic purpose of the original.

12.5 In the event of any inconsistency between the English version of these Terms and any translated version, the English version shall prevail.
